Welcome to QubitHire, an enterprise AI-powered recruitment platform. By accessing or using our services, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By creating an account, accessing any QubitHire portal (Careers, Enterprise, Platform, or Insights), or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you are using QubitHire on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Services

2.1 QubitHire Platform

QubitHire is a multi-tenant SaaS platform consisting of four integrated portals:

• QubitHire Careers: Candidate-facing portal for job search, applications, and career management
• QubitHire Enterprise: Recruiter and hiring manager portal for applicant tracking, candidate management, and recruitment workflows
• QubitHire Platform: Public-facing website for marketing, product information, and lead generation
• QubitHire Insights: Administrative portal for system monitoring, analytics, and platform management

2.2 AI-Powered Features

QubitHire utilizes artificial intelligence and machine learning to provide:

• Resume parsing and data extraction
• Candidate-to-job matching and recommendations
• Automated screening and ranking
• Intelligent search and filtering
• Predictive analytics and insights

Note: AI recommendations are assistive tools and should not be the sole basis for hiring decisions. Final decisions remain the responsibility of human recruiters and hiring managers.

2.3 Multi-Tenant Architecture

QubitHire operates as a multi-tenant platform where each organization (tenant) has isolated data and separate authentication. You will only have access to data within your authorized tenant(s).

3. Account Registration and Eligibility

3.1 Eligibility

To use QubitHire, you must:

• Be at least 16 years of age
• Have the legal capacity to enter into binding contracts
• Provide accurate and complete information during registration
• Maintain the security and confidentiality of your account credentials

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your password and account
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach
• Enabling multi-factor authentication (MFA) when available

3.3 Account Types

• Candidate Accounts: For job seekers using QubitHire Careers
• Recruiter/Employee Accounts: For users within tenant organizations
• Administrator Accounts: For tenant admins and system administrators

4. User Responsibilities and Acceptable Use

4.1 Acceptable Use

You agree to use QubitHire only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Violate any applicable laws, regulations, or third-party rights
• Upload or transmit malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to any part of the platform
• Interfere with or disrupt the integrity or performance of the services
• Scrape, crawl, or harvest data from the platform without authorization
• Impersonate another person or entity
• Post false, misleading, or discriminatory content
• Use the platform for spam, phishing, or other abusive activities
• Reverse engineer, decompile, or disassemble any part of the platform

4.2 Content Standards

All content you submit (resumes, job descriptions, profiles, etc.) must:

• Be accurate and truthful
• Not infringe on intellectual property rights
• Not contain offensive, discriminatory, or harmful material
• Comply with employment laws and regulations
• Not include personally identifiable information of third parties without consent

4.3 Employment Compliance

Organizations using QubitHire Enterprise must:

• Comply with all applicable employment and labor laws
• Ensure non-discriminatory hiring practices
• Obtain necessary consents for candidate data processing
• Provide fair and transparent recruitment processes
• Not use AI features in ways that violate anti-discrimination laws

5. Subscription and Payment Terms

5.1 Subscription Plans

QubitHire offers various subscription tiers with different features and pricing. Details are available on our pricing page.

5.2 Billing

• Payment Methods: We accept major credit cards, ACH transfers, and wire transfers
• Billing Cycles: Monthly or annual subscriptions, billed in advance
• Automatic Renewal: Subscriptions automatically renew unless canceled before the renewal date
• Price Changes: We reserve the right to modify pricing with 30 days' notice

5.3 Refunds and Cancellations

• You may cancel your subscription at any time from your account settings
• Cancellations take effect at the end of the current billing period
• No refunds are provided for partial subscription periods
• Enterprise contracts may have different cancellation terms as specified in agreements

5.4 Free Trials

• Free trials are available for eligible new customers
• No payment information required during trial (for basic plans)
• After trial expiration, you must subscribe to continue using premium features
• One free trial per organization

6. Intellectual Property Rights

6.1 QubitHire's Rights

All intellectual property rights in the QubitHire platform, including but not limited to software, algorithms, designs, logos, trademarks, and content are owned by or licensed to QubitHire. These Terms do not grant you any ownership rights to our intellectual property.

6.2 User Content License

By uploading content to QubitHire (resumes, job descriptions, profiles, etc.), you grant us a worldwide, non-exclusive, royalty-free license to:

• Use, reproduce, and store your content to provide the services
• Process your content with AI/ML models for matching, recommendations, and analytics
• Create anonymized, aggregated data for service improvement
• Display your content to authorized users within the platform

You retain ownership of your content. This license terminates when you delete your content or account, except where retention is required by law or for legitimate business purposes.

6.3 Feedback

Any feedback, suggestions, or ideas you provide about QubitHire may be used to improve the platform without compensation or attribution.

7. Data Privacy and Protection

Our collection, use, and protection of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

• Multi-tenant data isolation ensures privacy between organizations
• You have rights to access, correct, and delete your personal data
• We comply with GDPR, CCPA, and other applicable privacy regulations

8. Service Availability and Support

8.1 Uptime and Availability

We strive to maintain 99.9% uptime for the QubitHire platform. However, we do not guarantee uninterrupted access and may perform scheduled maintenance with advance notice.

8.2 Support

• Documentation: Help center and knowledge base available 24/7
• Priority Support: Available for enterprise customers per their agreements
• Response Times: Vary based on subscription tier and severity

8.3 Service Modifications

We reserve the right to:

• Modify, suspend, or discontinue features with reasonable notice
• Update the platform for improvements, security, or compliance
• Change APIs and integrations with deprecation notices

9. Third-Party Services and Integrations

QubitHire may integrate with third-party services (OAuth providers, calendar apps, ATS systems, etc.). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services or content.

10. Disclaimers and Warranties

10.1 "AS IS" Basis

QubitHire is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of uninterrupted or error-free operation
• Warranties regarding accuracy, reliability, or completeness of content
• Warranties that defects will be corrected

10.2 AI Accuracy

While we strive for accuracy, AI-generated recommendations, matches, and insights may contain errors or biases. Users should verify information and make independent judgments. QubitHire is not responsible for hiring decisions made based on AI recommendations.

10.3 No Employment Guarantee

QubitHire facilitates recruitment processes but does not guarantee job placements, interviews, or hiring outcomes for candidates.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUBITHIRE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions or data loss
• Damages arising from unauthorized access or security breaches
• Damages resulting from reliance on AI recommendations
• Actions of other users or third parties

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID TO QUBITHIRE IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless QubitHire, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of QubitHire
• Your violation of these Terms
• Your violation of any law or third-party rights
• Content you submit or actions you take on the platform
• Employment decisions made using QubitHire

13. Termination

13.1 Termination by You

You may terminate your account at any time by:

• Using the account deletion feature in settings
• Contacting rahul@qubitware.in

Upon termination, your access to the platform will cease, and your data will be handled according to our Privacy Policy.

13.2 Termination by Us

We may suspend or terminate your account immediately if:

• You violate these Terms or our policies
• Your account is used for fraudulent or illegal activities
• Payment obligations are not met
• We are required to do so by law
• We discontinue the service (with reasonable notice)

13.3 Effect of Termination

• All rights and licenses granted to you will immediately cease
• You must cease all use of QubitHire
• Provisions that should survive (liability, indemnification, etc.) will remain in effect
• No refunds will be provided for prepaid subscription periods

14. Dispute Resolution

14.1 Informal Resolution

Before filing a legal claim, you agree to first contact us at rahul@qubitware.in to attempt to resolve the dispute informally. We will respond within 30 days.

14.2 Arbitration Agreement

Any disputes arising from these Terms or your use of QubitHire shall be resolved through binding arbitration, except where prohibited by law. You waive the right to participate in class actions or class arbitrations.

14.3 Exceptions

Either party may seek injunctive relief in court for intellectual property violations or urgent matters.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of India, without regard to conflict of law principles. Any legal action or proceeding shall be brought in the courts located in Bangalore, India, and you consent to the jurisdiction of such courts.

For users in the European Union, you may also have the right to bring claims in your country of residence.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and QubitHire regarding the platform and services.

16.2 Modifications

We may modify these Terms at any time. Material changes will be notified via email or in-app notification. Continued use after changes constitutes acceptance. You will be required to accept updated Terms upon your next login.

16.3 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16.4 Waiver

Failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

16.5 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

16.6 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control (natural disasters, pandemics, acts of war, etc.).

16.7 Language

These Terms are provided in English. Any translations are for convenience only, and the English version shall prevail in case of discrepancies.
